Despite the state of the economy in the past year, PSM, security, and Emergency Management have continued to move forward technically and also on the regulatory front.
• The Chemical Facility Anti-terrorism Standard reached its third and most important phase, the preparation and submission of Site Security Plans (SSP) this summer. This process is ongoing as DHS has sent out letters to CFATS facilities with final risk tier assignments on a rolling basis.
• OSHA has announced the commencement the Chemical NEP program. This will be patterned after the refinery NEP, which is in its final phase. The Chemical NEP will be piloted from July 1009-July 2010 in OSHA Regions 1, 7, and 10. PSM facilities that have VPP Star/merit status, or are located in state-plan states, are exempt unless OSHA visits the facility for an unprogrammed reason (i.e., employee complaint, incident).
• OSHA’s combustible dust NEP has proceeded apace and a combustible dust standard may not be far behind.
